Terms of Service

1. Acceptance of Terms

By accessing or using Blitsee ('Service'), you agree to be bound by these Terms of Service ('Terms'). If you disagree with any part of the terms, you may not access the Service. Blitsee provides a WhatsApp automation and AI-powered customer service platform for e-commerce businesses. These Terms apply to all users of the Service, including company owners, employees, and administrators.

2. Description of Service

Blitsee offers: • WhatsApp Business API integration and automation • AI-powered chatbot in Moroccan Darija and other languages • Order management and tracking systems • Delivery integration with third-party services (e.g., Sappress) • Analytics and reporting tools • Customer relationship management features We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts and Registration

To use Blitsee, you must: • Provide accurate, complete registration information • Be at least 18 years old or the age of majority in your jurisdiction • Represent a legitimate business entity • Maintain the security of your account credentials • Notify us immediately of any unauthorized access You are responsible for all activities under your account. Company owners may create employee accounts and are responsible for their employees' use of the Service.

4. Acceptable Use Policy

You agree NOT to: • Use the Service for any illegal purposes • Send spam or unsolicited messages through WhatsApp • Violate WhatsApp's Terms of Service or Business Policy • Impersonate others or provide false information • Interfere with or disrupt the Service • Attempt to gain unauthorized access to our systems • Use the Service to harass, abuse, or harm others • Scrape, copy, or misuse our AI models or proprietary technology Violation of this policy may result in immediate account suspension or termination.

5. WhatsApp Integration

By connecting your WhatsApp account to Blitsee: • You authorize us to send and receive messages on your behalf • You remain responsible for compliance with WhatsApp's policies • You acknowledge that WhatsApp is a third-party service outside our control • You understand that WhatsApp may modify or terminate their API at any time We are not responsible for WhatsApp's actions, outages, or policy changes that may affect the Service.

6. AI and Automated Responses

Our AI chatbot: • Provides automated responses based on your configuration • May not always be 100% accurate • Should be monitored and supervised by you • Can be overridden or controlled by you at any time You are responsible for: • Reviewing and approving AI response templates • Monitoring customer interactions • Ensuring AI responses comply with applicable laws • Taking over conversations when necessary

7. Fees and Payment

Subscription fees are billed in advance on a monthly or annual basis. You agree to: • Provide valid payment information • Pay all fees when due • Authorize automatic renewal unless cancelled • Pay any applicable taxes We reserve the right to: • Change our pricing with 30 days' notice • Suspend service for non-payment • Charge late fees for overdue payments Refunds are provided at our discretion. Cancellation does not entitle you to a refund of prepaid fees.

8. Data and Privacy

We collect and process data as described in our Privacy Policy. By using Blitsee: • You grant us rights to process customer data necessary to provide the Service • You represent that you have rights to share customer data with us • You remain the data controller of your customer information • You agree to comply with applicable data protection laws (GDPR, etc.) For Morocco-based businesses: You acknowledge compliance with Law 09-08 regarding personal data protection.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Blitsee and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of: • Your business data • Customer information you collect • Content you create within the Service You grant us a license to use your data solely to provide and improve the Service.

10. Termination

Either party may terminate this agreement: • You may cancel your subscription at any time • We may terminate for violation of these Terms • We may terminate with 30 days' notice for any reason Upon termination: • Your access to the Service will be disabled • You may export your data within 30 days • We will delete your data per our retention policy • Outstanding fees remain payable

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: • THE SERVICE IS PROVIDED 'AS IS' WITHOUT WARRANTIES • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES • OUR TOTAL LIABILITY SHALL NOT EXCEED FEES PAID IN THE LAST 12 MONTHS • WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES (WhatsApp, delivery partners) Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold Blitsee harmless from any claims, damages, or expenses arising from: • Your use of the Service • Your violation of these Terms • Your violation of any third-party rights • Your customer communications or business practices

13. Changes to Terms

We may modify these Terms at any time. We will: • Notify you of material changes via email or Service notification • Provide at least 30 days' notice before changes take effect • Post the updated Terms with a new 'Last Updated' date Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Morocco, without regard to conflict of law provisions. Any disputes shall be resolved through: 1. Good faith negotiation 2. Mediation if negotiation fails 3. Competent courts of Casablanca, Morocco For international users: You also agree to comply with your local laws regarding online conduct and acceptable content.
